1. Eligibility

1.2 Legal Capacity

By using our Services, you represent and warrant that you have the legal capacity to enter into a binding contract.

1.3 Prohibited Jurisdictions

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.

2.3 KYC/AML Compliance

We may require you to complete identity verification procedures to comply with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations. Failure to comply may result in suspension or termination of your account.

3. Services

3.1 Description of Services

Beehive.Trading provides an AI-powered investment platform that utilizes advanced algorithms for trading in Forex and cryptocurrency markets. Access to certain Services requires the purchase of our Non-Fungible Tokens (NFTs).

3.2 No Investment Advice

All information provided through our Services is for informational purposes only and should not be construed as investment advice. Consult a qualified financial advisor before making any investment decisions.

4. NFTs and Membership

4.1 Purchase and Ownership

By purchasing a Beehive.Trading NFT, you gain access to membership benefits as outlined on our website. Ownership of the NFT is verified through blockchain technology.

4.2 Transfer and Resale

You may transfer or resell your NFT in accordance with applicable laws. However, transferring your NFT will terminate your access to the associated membership benefits.

4.3 No Refunds

All NFT purchases are final and non-refundable unless required by law.

5. User Obligations

5.1 Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Services.

5.2 Prohibited Activities

You agree not to:

• Use the Services for any unlawful purpose.

• Circumvent any content filtering techniques employed by us.

• Access or use the Services from a prohibited jurisdiction.

• Engage in any activity that could harm or disrupt the Services.

6. Risk Disclosure

6.1 Investment Risks

Investing in Forex and cryptocurrencies involves significant risk, including the potential loss of your entire investment. Past performance is not indicative of future results.

6.2 No Guarantees

We do not guarantee any returns on investments. You acknowledge that you are solely responsible for any investment decisions you make.

7. Fees and Payments

7.1 Fees

We charge a 0% annual fee on assets under management (AUM) and a 30% performance fee on profits. These fees may be updated from time to time with prior notice to you.

7.2 Payment Terms

All payments must be made in the currency specified and via the payment methods designated by us. You are responsible for any applicable taxes or charges imposed by any governmental authority.

8. Intellectual Property Rights

All content, features, and functionality on the Services, including but not limited to information, software, text, displays, images, and the design, are owned by Beehive.Trading or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Confidentiality

You agree not to disclose any confidential information obtained from us or through the Services to any third party without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Beehive.Trading and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Services.

• Any conduct or content of any third party on the Services.

• Any content obtained from the Services.

11. Indemnification

You agree to indemnify and hold harmless Beehive.Trading, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your violation of these Terms or your use of the Services.

12. Termination

12.1 Termination by User

You may terminate these Terms by discontinuing use of the Services and deleting your account.

12.2 Termination by Company

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including but not limited to your breach of these Terms.

12.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Privacy Policy

Your use of the Services is also subject to our Privacy Policy, which details how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in the Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Panama, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration conducted in Panama, in accordance with the rules of UNCITRAL Model Law. The arbitrator's decision shall be final and binding.

16. Amendments

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days notice before any new terms take effect. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Beehive.Trading regarding the use of the Services and supersede any prior agreements between us.

19. Prohibited Jurisdictions

19.1 Compliance with International Sanctions

You affirm that you are not located in, under the control of, or a national or resident of any country or territory that is subject to United Nations Security Council Sanctions List, or any other trade or economic sanctions imposed by any governmental authority.

19.2 List of Prohibited Countries

For clarity, the Services are not offered to individuals or entities in the following countries or regions:
